Impact of Law on the Production of Subjectivity in the Sphere of Care. Legal Techniques for the Government of the Self and of the Others in the Transition Between the Familialist Welfare and Neoliberal Commodification

It is argued that Law is a complex social, normative, and axiological phenomenon for which the shaping and intervention on the subjective dimension is relevant. First, this is presented abstractly, based on Foucault’s work and governmentality studies. Then, this hypothesis of relevance is specified for the legal treatment of care employment, where 1) its legal-political understanding is presented. 2) The evolution of its regime from the southern European welfare states of the 20th century to a generalized neoliberal model is highlighted. 3) Some techniques of subjectivation in the specific area of preparation of hotel rooms in tourist sector and the struggle around the measurement and organization of the workday are detailed.
