Constitutionalism, positivism and rights

In the story of constitutionalism coexist two notions of constitution: descriptive and prescriptive. The descriptive is the empirical experience of the constitutions and the prescriptive is what the constitution should be. This article proposes an interpretation that uses both notions, in the empirical and theoretical scope to understand more clearly some of the major problems that should answer a general theory of the constitution: a) How to reconcile the empirical diversity of constitutions? b) When a constitution should be considered as an element that expresses the rationalization and autonomy of the legal system? c) In our time a constitution should guarantee the rights fundamental.
